Why I Choose to Mediate

The naïve look upon jury trials the way the poor look upon the lottery – A way to get rich quick. The reality is quite the opposite. Thirty-One years as a trial judge taught me that all jury trials have something in common, someone always loses. Frequently, there is more than one loser. Sometimes, there is no winner.  Certainly there are civil disputes that cannot be resolved without a decision by a jury. But the majority should settle. I believe in mediation because the process is less expensive, less time consuming and usually produces results that are fair and just.

Biography

Judge Maloney earned his B.S. in Biology from Wheeling Jesuit University in 1969 and his law degree from the University of Florida in 1973. He was an assistant Public Defender in the Tenth Judicial Circuit until elected Polk County Judge in 1977.  Judge Maloney was appointed to the Circuit Court in 1983 and served that capacity until 2008.  He has served in all divisions of both courts with the last twelve years evenly divided between Circuit Civil and Felony.
